After a Liability Order has been granted we can use the following options to help us collect the outstanding debt:
Attachment of Earnings
We can order your employer to deduct a percentage of your wages or salary and send it directly to us.
An attachment of earnings order will continue until the whole charge is paid.
Both you and your employer have a duty to keep us informed if you change employment.
Your employer can add £1.00 each time they make a deduction to cover their own costs.
Benefit Deductions
The council can request that the Department for Work and Pensions (DWP) deduct money from your payments, including Income Support and Job Seekers Allowance.
Deductions from benefit will only be made where the claimant is named in the Liability Order.
Bailiffs
We can instruct bailiffs to collect Council Tax debt for us. We will always send a final letter to warn you that your account will be passed to the bailiff company if you do not pay or make a payment arrangement.
A bailiff may consider giving you time to pay, but you must agree to what he considers to be a satisfactory arrangement.
If the bailiff allows you time to pay he will normally enter into a ‘walking possession’ agreement with you. This means that he will make a list of goods in your house up to the value of the debt and his costs. You will be required to sign this and there will be an additional levy fee and walking possession fee to pay.
When your goods are subject to a walking possession agreement you may not dispose of the goods without the bailiff’s permission.
If you break the arrangement with the bailiff he may re-enter your property to take the goods.
